MLT Argues Important Case on Lawyer’s Duty of Loyalty at Supreme Court of Canada

Doug Hodson, and Ryan Lepage recently represented Canadian National Railway before the Supreme Court of Canada on an appeal dealing with the scope of the lawyer’s duty of loyalty to a current client (Canadian National Railway v. McKercher LLP et al., SCC Appeal no. 34545). This appeal deals with the important issue of conflicts of interest and whether it is appropriate for a law firm to sue its own client on behalf of another client. Judgment has been reserved.
