Bob Leurer is one of Canada’s most experienced class action lawyers and leading civil litigators.

  • Good Spirit School Division No. 204 v. Christ the Teacher Roman Catholic Separate School Division No. 212 and The Government of Saskatchewan, (2017 Sask QB):  concerning the constitutionality of government funding for non-minority faith students who attend minority separate schools in the province. It is, as Justice Layh described in the judgment, “one of the most significant lawsuits in the province’s history.”
  • Roberts Properties Inc. v. SaskPower, 2016 SKCA 31, obtaining summary dismissal of a proposal class action.
  • Zurich Life Insurance Company Limited v. Branco, 2015 SKCA 71, overturning, as new counsel brought in for the appeal, a trial judgment that had previously been the largest punitive damages award against an insurer in Canadian history.
  • SaskEnergy Incorporated v. ADAG Corporation Canada Ltd., 2015 SKQB 143, successfully obtaining judgment after trial in a complex commercial dispute obtaining ownership of a multi-million dollar office tower.
  • Sandoff v. Loblaws, 2015 SKQB 345, successfully obtaining summary judgment dismissal of proposed class action.
  • Jackson v. Canadian National Railway, 2013 ABCA 440, aff’g 2012 ABQB 652 (leave to appeal to SCC dismissed May 29, 2014, SCC No. 35730), successfully obtaining summary dismissal of a proposed class seeking hundreds of millions of dollars as a result of the alleged overcharging for carriage of grain in Western Canada.
  • Drover et al. v. BCE Inc. et. al., 2012 BCSC 50, obtaining dismissal of this proposed class action as an abuse of process.
  • Saskatchewan Government Insurance v. Wilson, 2012 SKCA 106, successfully representing an insurer overturning a previous trial award of punitive damages.
  • Ongoing representation of defendants in numerous on-going class actions, including in areas of securities law, pharmaceutical products and other product liability, sales tax and others.
  • Representation of defendants in numerous class action settlements.
  • Hoffman et al. v. Monsanto Canada Inc. and Bayer CropScience Inc., 2007 SKCA 47. Successfully opposing certification of a class action arising from the introduction of genetically modified canola.
  • Brooks et al. v. Canadian Pacific Railway Limited, 2007 SKQB 247. Representing the defendant in an action denying certification of a proposed class action seeking damages arising from a train derailment.
  • Frey et al. v. BCE Inc. et al., 2013 SKCA 26, 2011 SKCA 136, aff’g 2009 SKQB 165, 2007 SKQB 328 (related proceedings Drover et al v. BCE Inc., 2012 BCSC 50), an ongoing class action against various wireless service providers in connection with “system access fees” charged by the providers.
  • Cargill v. Makarenko, 2009 SKQB 235. Successfully enjoining the use of misappropriated corporate information.
  • R.L.T.V. Investments Inc. v. Saskatchewan Telecommunications, 2009 SKCA 83, leave to appeal refused (S.C.C. March 11, 2010). Obtained summary judgment dismissing derivative action in complex commercial case.
  • Collins v. BCE Inc. et al., 2010 SKQB 74. Obtaining a stay of a proposed class action as an abuse of process of the court.

Bob has acted on complex commercial, product liability, agricultural, insurance and pharmaceutical claims. Acting primarily for defendants, many of them large, publicly-traded corporations, he has argued leading cases before the Supreme Court of Canada, the Federal Court of Canada and in Courts throughout Western Canada. He is regular speaker at national and regional legal conferences.

Bob was lead plaintiff’s counsel on a trial that saw the largest judgment ever awarded by a jury in Saskatchewan. It was also one of the largest in Canadian judicial history.

Bob was the 1984 Gold Medalist at the College of Law, University of Saskatchewan, and clerked to the Honourable Mr. Justice W.Z. Estey of the Supreme Court of Canada.
