How we help

MLT Aikins provides a suite of full-service and cost-effective mortgage enforcement services. Clients benefit from having senior and experienced lawyers as their primary points of contact in each of the four western Canadian provinces.

We engineer sound mortgage enforcement solutions for secured and unsecured commercial and residential properties, while saving financial institutions and lenders both time and money. Our firm is uniquely qualified to handle the large volume of business generated by financial institutions in Western Canada.

Our range of services includes issuing demand letters, statements of claim, notices of sale and writs of possession; listing, negotiating and conducting the property sale, including approval of clean-up and repair quotes prior to listing; filing claims with mortgage insurers; correcting title problems; receiving reinstatement/redemption or sale proceeds; and collecting mortgage deficiencies.

If complicated and sophisticated litigation or commercial real estate work is required, MLT Aikins lawyers in those practice areas are available to assist.

Whether you need mortgage enforcement services for a single property, an agricultural property or a sizeable property portfolio, MLT Aikins will simplify the process and present solutions tailored to your needs.

MLT Aikins debt realization group offers a hybrid model – carrying out both the tasks of a call centre and a law firm. Unique among western Canadian law firms, this model allows us to provide clients with comprehensive services on the full debt realization spectrum.

Our lawyers are experienced in the fields of insolvency, restructuring and debt recovery. We act for financial institutions, lenders and insolvency professionals to offer practical solutions when collections action is required.

Our client base includes major financial institutions, auto and equipment financiers, finance and leasing companies, credit unions, mortgage insurers, debt buyers and collection agencies. While all clients want to maximize recoveries, MLT Aikins recognizes that each situation is distinct with its own challenges and specific requirements.

Call Centre

Our work in dealing with collection matters is based on a program designed to ensure expediency, efficiency and enforcement – all while providing economical results for our clients. At our Regina call centre, negotiations are performed by collections specialists, which can then be escalated to our skilled paralegals and assistants.

Judgment Enforcement

If collection at the call centre level proves unsuccessful, we can further escalate matters to our lawyers. This includes litigation, obtaining judgments and executing on those judgments by way of attachment, garnishment of wages, garnishment or sale of commercial or personal property. This also includes proceedings under the federal Companies’ Creditors Arrangement Act (CCAA).

We offer clients a unique full-service model based on retaining a collection agency and a law firm, further bolstered by our unique relationship management approach. Senior and experienced commercial litigators in each province manage the practice group and handle the most sophisticated and complicated matters. More importantly, senior litigators also act as primary client contacts to ensure the program meets their needs, accesses the right resources, and sets fair and reasonable rates and costs for both parties. As a result, clients always have a point of contact to deal quickly and efficiently with any concerns or complexities.
