Kyle’s competition law practice focuses on transactional matters, regulatory notifications and approvals, government investigations, critical antitrust litigation and general competition and communications law compliance counselling (including marketing and advertising laws).

He also has leading expertise in other specialty regulatory areas, including: Foreign investment law – including Canada’s national security review and cultural sector review regimes under the Investment Canada Act; communications law – including telecommunications licensing, spectrum management, foreign ownership restrictions, policy matters and competitive disputes; transportation law – including merger review under the Canada Transportation Act and airline joint venture immunity applications; and pharmaceutical regulation – including anti-kickback and drug pricing and rebate legislation.

He recently served a term at the Competition Bureau Legal Services unit of the Department of Justice Canada, representing the Commissioner of Competition in connection with merger reviews, abuse of dominance inquiries and deceptive marketing practices investigations.

Kyle has advised:

  • Clients involved in some of the most high-profile, complex and contested merger reviews under the Competition Act. For example:
    • Videotron Ltd. in connection with Rogers Communications Inc.’s $26-billion acquisition of Shaw Communications Inc. and the sale of Shaw’s wireless business, Freedom Mobile, to Videotron for $2.85 billion, including in successfully defending the Commissioner of Competition’s challenge to this historic merger before the Canadian Competition Tribunal and Federal Court of Appeal
    • Tervita Corporation in its merger with Secure Energy Services Inc. to create a combined company with an implied total enterprise value of $2.3 billion, including successfully defending the Commissioner of Competition’s original interim injunction application.
    • A global, research-based biopharmaceutical company regarding all competition law matters and filings in connection with its acquisition by a U.S.-based pharmaceutical company for more than US$60 billion
  • Big Tech clients in connection with Competition Act civil conduct investigations
  • Foreign investors and Canadian target companies in connection with “net benefit,” cultural sector and over a dozen full-blown national security reviews under the Investment Canada Act
  • A Canadian airline in connection with its merger with another Canadian airline and the related Competition Act and Canada Transportation Act (public interest) reviews and approvals
  • A Canadian telecommunications company in connection with multiple sales of wireless spectrum licences and the related Competition Act and Telecommunications Act reviews and approvals
