Benchmark’s selection process consists of an extensive four-month research period in which researchers conduct interviews with litigators and clients and examine recent casework handled by the firms. Benchmark researchers consult with external sources to gain professional opinions on litigators and select award recipients based on these insights.

Benchmark identifies firms and individual litigators based on their strengths “in a particular practice area – either exclusively or as a specialty component of their general practice. These practice areas include intellectual property, insurance, securities, competition, insolvency, product liability, international arbitration and the Canadian practices of energy law and aboriginal law.”
